Penalty: 1. Mr Pervez Rahman be reprimanded pursuant to section 299(1)(b) of the Uniform Law. 2. Pursuant to section 299(1)(e) Mr Pervez Rahman is required, within 6 months of the date of the determination, to complete the Law Institute of Victoria's Bookkeeper's Trust Recording Workshop or other similar trust accounting course. This is in addition to his annual requirement to complete 10 units of Continuing Professional Development.

Penalty: The practitioner was found guilty of three charges of unsatisfactory professional conduct under the Legal Profession Uniform Law (Vic) Orders made on 21/11/2018 1. With the agreement of the practitioner, the practitioner is reprimanded and may not apply for a principal practising certificate for a period of two years from 21 November 2018. 2. By 4.00 PM on 7/12/2018 the parties are to provide proposed minutes of consent orders as to costs or written submissions in respect of the costs. The parties have agreed that the question of costs may be decided on the papers. Costs order made on 9/01/2019 3.By consent, the practitioner is to pay the Victorian Legal Services Commissioner's costs of this proceeding fixed in the sum of $8,000.00 payable by the way of twelve (12) consecutive monthly instalments with the first instalment to be paid on or before 4/01/2019 and thereafter by the 4th day of the following months.

Penalty: The Court of Appeal Orders that: 1. The application for leave to appeal is dismissed. 2. The practitioner's application to rely on further evidence is dismissed. 3. The practitioner pay the Victorian Legal Services Commissioner's costs on the standard basis.

Finding: Professional Misconduct under the Legal Profession Act 2004 (Vic)
Penalty: Mr Gullquist sought leave to appeal VCATs decision pursuant to s148 of the Victorian Civil and Administrative Tribunal Act 1998. The Court found that Mr Gullquist did not identify an error of law about which there was any real or significant doubt such as would warrant leave to appeal in relation to any of the questions of law or proposed grounds of appeal identified in his submissions. Further, the Court was not satisfied that the Tribunal fell into error. Leave to appeal was refused and the proceeding was dismissed. Mr Gullquist was ordered pay the LSCs costs of the proceeding.
